PADI dive shop owner accused of scuba murder may waive extradition

PROVIDENCE, Rhode Island (6 Jan 2007) — American dive shop owner David Swain may waive extradition on a murder charge.

Swain's lawyer, Neal Tessel said that his client is anxious to get on with the case.

Swain has been charged in the British Virgin Islands with murdering his wife, Shelley Tyre, in 1999 while the couple was scuba diving in Tortola.

If Swain waives extradition, he will have to go to the British Virgin Islands for trial.

In 2006, a Rhode Island court found Swain liable for millions of dollars in damages in a civil lawsuit filed by Tyre's parents.

Swain still owns a dive shop in Jamestown, Rhode Island, which sells scuba diving courses and equipment, however, his PADI instructor status was revoked in April, 2006.
