TORTOLA, British Virgin Islands (16 Feb 2009) — The murder trial of former dive center owner David Swain will be delayed until May or June. Swain, 52, is charged with murdering his 46-year-old wife, Shelly Tyre, while the couple was scuba diving at The Sound off Cooper Island in Tortola in 1999. The Jamestown resident has been held in a Tortola prison for a year since BVI authorities reviewed the record of a 2006 Rhode Island civil case that found Swain guilty of murdering his wife. During the civil trial, experts who examined the evidence testified that Tyre's death must have resulted from murder. Swain was extradited to the British Virgin Islands in February 2008 after the United Kingdom made a diplomatic request for extradition. The case was postponed in October in order to give Swain time to raise more money for his defense. This time, authorities said the delay was due to conflicting schedules among lawyers and witnesses. Swain owned Ocean State Scuba, a PADI 5-Star dive shop located in Jamestown. He allegedly killed his wife on March 12, 1999, the last day of their holiday in the British Virgin Islands. |
