TORTOLA, British Virgin Islands — A PADI dive shop owner convicted of killing his wife during a 1999 scuba trip to the British Virgin Islands should serve at least 25 years in prison before getting parole, prosecutors told a judge. A jury found David Swain, 53, of Jamestown, Rhode Island, guilty of murder, so he automatically receives a life sentence, however, the new Parole Act enables judges to decide whether convicted murders can be eligible for parole after serving a minimum sentence. Defense attorney Hayden St. Clair-Douglass asked the judge to allow Swain to serve 18 years before being eligible for parole, arguing that his client had no prior criminal convictions and was supported by written testimonials from friends and family. Prosecutor Grace Henry-McKenzie argued that Swain should serve at least 25 years, because he killed his wife, Shelley Tyre, for financial gain and to pursue a romance with another woman. The judge is expected to sentence Swain on November 10. |
