NOVA SCOTIA, Canada (25 July 2005) -- A Digby County company has been found guilty of health and safety violations in the death of a commercial diver. Steven Allan Moore, 40, went diving for sea urchins near Sandy Cove one morning in March 2003. Other divers resurfaced; he didn't. Moore's body was recovered three days later. The captain of the dive boat, Dwayne Theriault, and his company were both charged with four counts under the Occupational Health and Safety Act. Investigators found Moore did not have a knife, backup air supply or a lifeline. On Monday, Theriault was found not guilty. But Courtnakyle Fisheries Ltd. was found guilty of two counts of failing to take every precaution to ensure the safety of an employee. The company will be sentenced in October. The Crown is asking for fines in excess of $20,000. SOURCE - CBC |
