WARWICK, UK (9 Dec 2003) -- A company in charge of a learner diver who drowned in the Lake District has admitted breaking a health and safety law. Paul Gallacher, 33, from Leicester, drowned during a trip organised by Stoney Cove Marine Trials, based in Leicestershire. Warwick Crown Court was told Mr Gallacher travelled to Wastwater, in Cumbria, for a diving course with Stoney Cove Marine Trials in October 2000. But the prosecution said, according to his log book, Mr Gallacher had not completed and logged enough dives for the course and had never been deeper than 45m. On this occasion he reached depths of almost 60m. During the dive in Wastwater, Mr Gallacher got into difficulty and despite attempts to rescue him he suffered convulsions and drowned. The court was told his instructor had not checked Mr Gallacher's written records and failed to carry out a full risk assessment of the unfamiliar lake. Judge Martin Coates adjourned sentencing until 23 December after the firm admitted an offence under Section 3 of the Health and Safety At Work Act. |
